Buying property in Chiang Mai as a foreigner

Yes, for a condominium. You can own a Chiang Mai unit freehold, in your own name, with no approval and no minimum price. You cannot own the land under a house. You should still rent. Absorption here is 1.6% a month, which is 57 months of unsold stock (The Thaiger, 17 July 2026). Selling means joining that queue.

Thailand cut the transfer fee for Thai buyers and left you out

Thai nationals pay a 0.01% transfer fee on a home up to THB 7 million ($212,800). Cabinet extended that relief on 30 June 2026. Foreigners do not get it. If you are moving to Chiang Mai and buying, you pay the full 2% (The Thaiger, 17 July 2026).

On a THB 3.1 million ($94,200) flat, that one gap is about THB 61,700 ($1,875).

The fee is the small problem. The exit is the large one. Absorption ran at 1.6% a month in August 2025. That is 57 months of unsold stock, up from 47 months a year earlier (The Thaiger, 17 July 2026).

Five years of stock is a renter's market. It is also a seller's trap.

What you can own, and what you can only borrow for thirty years

A condominium unit, freehold. Foreign buyers may hold up to 49% of a building's saleable floor area. There is no minimum price, no approval process and no visa condition.

Not land. You cannot own it. Houses and villas are held on a 30-year registered lease, with a superficies or usufruct on top.

Not the reform you read about. In April 2024 Cabinet approved a study into a 75% quota and 99-year leases. No bill has passed. The cap is still the 1999 rule in September 2026. No primary parliamentary source could be fetched. CHECK

The money must arrive from abroad. Section 19 of the Condominium Act requires the full price to come in as foreign currency. Your Thai bank then issues a Foreign Exchange Transaction form, and the Land Office wants it at registration. Banks issue one only for transfers above USD 50,000. Below that you get a credit note instead (PropertyScout, read 10 September 2026). That is trade practice, not a published rule. CHECK

So open a Thai bank account early, and send the money in one wire.

What a THB 3.1 million one-bedroom actually costs

The average Chiang Mai one-bedroom asks about THB 3.1 million ($94,200), from FazWaz listings read on 10 September 2026 (Bamboo Routes). Take a 40 sqm unit.

Specific business tax of 3.3% applies if the seller held under five years. Otherwise it is 0.5% stamp duty. Custom puts both on the seller. Custom is not law.

Then it keeps costing. Common area fees run THB 25–180 per sqm a month, so THB 1,000–7,200 ($30–219) on 40 sqm. Land and building tax on a second home is 0.02–0.03% of appraised value. That is THB 620–930 ($19–28) a year (Thailand Condo Shop, read 10 September 2026).

Three traps, and what each one costs you

The quota-full building. About 15 or 16 of Chiang Mai's 100-plus condominium buildings sit at or near the 49% cap. Units in them resell 10 to 20% below comparable stock, because only Thai buyers can take them (The Thaiger, 17 July 2026). Get the building's foreign quota in writing before you pay.

The 30+30+30 villa lease. Agents sell it as 90 years. Supreme Court judgment 4655/2566 held that pre-agreed renewals beyond the first 30 years are void. It ran on a 1990 Phuket lease, where the tenant had paid up front for two extensions. Its number reads as 2023, but law firms report the ruling as 18 March 2025. They also put that payment at both THB 600,000 ($18,250) and THB 1.2 million ($36,500) (Addleshaw Goddard and Lexology, read 10 September 2026). CHECK You get thirty years. Price it as thirty.

The nominee company. A Thai company that holds land while you control it is a crime, not a workaround. On 20 July 2026 more than 250 officers raided 18 sites in Chiang Mai. Police filed 31 cases over 29 plots worth THB 633 million ($19.2 million), naming 74 suspects (Bangkok Post and The Thaiger, 20–21 July 2026). It was phase five of a national operation, and five more provinces are named next.

A guaranteed yield is the local version

A guaranteed-return condo scheme in Hang Dong drew over 100 buyers and THB 300 million ($9.1 million) in losses. The DSI has run the case since 2022 (The Thaiger, 24 October 2024).

A yield promise comes from a developer's cash flow, not from your flat. With 57 months of stock, ask who pays it in year three.

Two of those numbers are contested. The Thaiger put the city average at THB 60,000 per sqm ($1,824) on 17 July 2026. Bamboo Routes puts the median near THB 74,000 ($2,249), read 10 September 2026. Agents also quote 6 to 8% yields in Nimman and the Old City, against Numbeo's 5.43%. CHECK

The direction is contested too. Bamboo Routes has Chiang Mai foreign transfers up about 18% in Q1 2026, to 199 units. Another reading of REIC data has them down 28% across 2025. The book quotes Chinese purchases down 33.5% in the first half of 2025. CHECK

Rent. Buy only if you can name the decade

Rent. Nothing in the 2026 numbers softens that.

You pay 2.9% to 6.5% to get in. The centre yields 5.43% gross, before vacancy, fees and tax. You then sell into 57 months of stock, maybe from a quota-full building. National foreign transfers fell 17.3% in Q1 2026.

Renting a mid-band one-bedroom costs THB 10,000–28,000 a month ($304–851) as of September 2026. It carries no exit risk.

Buy only when four things are true. You will live in the flat for ten years. You found the exact unit, not a decent one. You can pay cash from abroad. And you accept a sale may take a year.

Buying to qualify for a visa? Check the rule first. The LTR visa takes $40,000 of passive income plus $250,000 in Thai assets on its pensioner track. A condominium can count. It is still not a good buy.

Where you buy matters as much as whether. The seven areas foreigners live in do not move together. The riverside also carries a flood record the price hides.
